The petitioner is languishing in custody for the offences punishable under Sections 25/AA/26/35 of the Arms Act and Section 37(b) of Bihar Prohibition and Excise Act. Only allegation against the petitioner is that when he was apprehended by the police he was found in drunken condition. Recovery of pistol etc. is alleged from the possession of the co-accused Gaurav Raj.

Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Special Case No.

Patna High Court CR. MISC. No.23692 of 2019(2) dt.15-04-2019 2/2 11190 of 2018 arising out of Phulwari Sharif P.S. Case No. 961 of 2018, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.
