JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-08-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered under Sections-386, 387 & other minor sections of the Indian Penal Code.
All the sections, except Sections-386 & 387, are bailable but submission on behalf of petitioners is that the present case has been brought by the informant on account of land dispute and as a matter of fact, land dispute is going on between the parties since long.
On the other hand, learned counsel, appearing for the informant points out that FIR named accused have been convicted in a murder case and they were granted privilege of bail by the
Patna High Court Cr.Misc. No.30216 of 2016 (3) dt.08-08-2016 2/2 appellate court and the present act of the petitioners and other accused, appears to be violation of the condition of bail. Learned counsel for the petitioners submits that petitioners have never been convicted in any case. However, considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioners named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Khagaria (Muffasil) P.S. Case No. 526 of 2014 to the satisfaction of learned Chief Judicial Magistrate, Khagaria.
