The petitioners, who are in custody, seek bail in connection with Kothi P.S. Case No. 39 of 2018 registered for the offence punishable under Sections 272, 273 of the Indian Penal Code and 30(a) of the Bihar Excise Amendment Act, 2016. Allegation against petitioner No. 1 is of recovery of 30 litres Mahua wine from his possession and 20 litres of Mahua wine from possession of petitioner No. 2 Vishwanath Paswan. Petitioners have no criminal antecedent and they are in custody since 09.08.2018.

Considering the aforesaid facts and circumstances of

Patna High Court Cr.Misc. No.57694 of 2018(2) dt.18-09-2018 2/2 the case, let the petitioners named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Special Excise Judge, Gaya, in connection with Kothi P.S. Case No. 39 of 2018.
