The petitioners apprehend their arrest in Goraul P.S. Case No. 64 of 2015, registered for the offences punishable under Sections 364, 365, 34 of the Indian Penal Code. The informant filed a complaint on the basis of which the present FIR was lodged. The informant alleged that Vinod Singh came and took his son Jaky Kumar for some urgent work, but her son did not return.
Learned counsel for the petitioners submits that Raja Singh @ Jaiky Kumar, the victim boy, was in love with Priyanka Kumari, daughter of petitioner no. 1. Jaiky Kumar solemnized marriage, but the informant and others demanded dowry for which Vinod Singh, petitioner no. 1 filed informatory petition on
Patna High Court Cr.Misc. No.36877 of 2015 (3) dt.05-11-2015 2/2 02.02.2015. Priyanka Devi, the wife of Jaiky Kumar filed complaint case on the basis of which Goraul P.S. Case No. 67/2015 was registered under Section 498A of the Indian Penal Code against Raja Singh @ Jaiky Kumar. Raja Singh @ Jaiky Kumar was apprehended and he was remanded in that case. Raja Kumar was never kidnapped.
Learned Additional P.P. has submitted that it has come that Raja Singh solemnized marriage with Priyanka Kumari without the consent of his parents.
Considering the facts aforesaid, the petitioners above named in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Goraul P.S. Case No. 64/2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) Rakhi U T
