Learned counsel for the petitioners is expected to honour his undertaking given in the instant case for depositing the requisite court fee and to remove the defects as pointed out by the office when called upon to do so by the office.

The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 406, 409, 420, 34 of the Indian Penal Code. It is alleged that petitioner No. 1 being

No.30340 of 2021(6) dt.27-04-2022 2/3 Chairman of the Implementation and Management Committee of Ward No. 1, Gram Panchayat Raj, Mathaur and petitioner No. 2 being Secretary of the said Committee have not completed the work under the scheme of Nal Ka Jal and during inspection, the register of the work was also not found properly maintained. It is submitted by learned counsel for the petitioners that petitioners have falsely been implicated in this case. From perusal of the case diary, it appears that 90 percent of the work has already been completed and with regard to remaining work, an amount of Rs. 1,74,598/- is still remains in the bank account of Ward Kriyanvan Avom Prabandhan Samiti.

In the facts and circumstance of the case, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) each with two sureties of the like amount each to the
