The petitioner, who is in custody, seeks bail in connection with Chutiya P.S. Case No. 19 of 2016 registered for the offence punishable under Sections 364, 302, 201, 120B of the Indian Penal Code.

Allegation against petitioner is that co-accused Deepak Kumar and deceased used to sell articles to the petitioner and on the dispute of distribution of stolen articles petitioner might have killed the deceased.

It has been submitted on behalf of the petitioner that petitioner is not named in the FIR. His name has surfaced on confessional statement of co-accused Deepak Kumar who has already been granted bail by the Juvenile Board. Petitioner is

Patna High Court Cr.Misc. No.59151 of 2018(2) dt.09-10-2018 2/2 innocent and has committed no offence. Petitioner has no criminal antecedent and he is in custody since 02.07.2018. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Dehri on Sone, in connection with Chutiya P.S. Case No. 19 of 2016.
