JUSTICE SUDHIR SINGH ORAL ORDER 24-10-2016 Heard learned counsel for the petitioners and the State. The petitioners seek bail in a case instituted for the offences under Sections 302/34 of the I.P.C.

Allegation is that the accused persons including the petitioners came at the house of the informant and abused and assaulted the father of the informant and when the informant came to save him he was also assaulted. Accused Radhe Ram assaulted the informant's father on his head, upon which he became senseless and fell down and died.

It has been submitted on behalf of the petitioners that the petitioners are in custody since 13.8.2015 and 19.10.2015 respectively and the charge sheet has been submitted in the present case. There is no allegation of tampering of witnesses

Patna High Court Cr.Misc. No.35661 of 2016 (3) dt.24-10-2016 2/2 alleged against the petitioners. General and omnibus allegation has been made against the petitioners. Specific allegation has been made against accused Radhe Ram. The other co-accused have been granted bail vide Annexures 4 and 5 to the present application.

On behalf of the State, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioners above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Jhanjharpur, District Madhubani in connection with Bhairab Asthan P.S. case No.22 of 2015.
