JUSTICE RAJENDRA KUMAR MISHRA ORAL JUDGMENT Date: 19-02-2015 The present contempt application is filed in compliance of the order dated 08.01.2013 passed in C.W.J.C. No. 5222 of 2012 whereunder the aforesaid writ petition of the petitioner was disposed of with observation that it will be open for the petitioner to file a fresh representation within a period of three weeks, stating details of his grievance and the claims with the supporting documents. In case, such representation is filed before the respondent no.3, the respondent no.3 shall consider the representation of the petitioner expeditiously,

Learned counsel appearing on behalf of the opposite parties no. 3 to 6, officials of the Bihar State Housing Board, Patna submits that in compliance of order dated 08.01.2013 passed in C.W.J.C. No. 5222 of 2012, the opposite party no.3, Managing Director, Bihar State Housing Board has considered the representation of the petitioner and a copy of the order has already been communicated to the petitioner vide Memo No. 859 on 31.01.2014, as detailed in paragraph no.4 of the show cause filed on behalf of the opposite party no.3.

On the other hand, learned counsel appearing on behalf of the petitioner submits that while there was direction to dispose of the representation of the petitioner preferably within three months but the representation of the petitioner has been disposed of after lapse of more than one year not in accordance with law. In view of the above submission, since the representation of the petitioner has already been disposed of by speaking order, the contempt application is disposed of.

However, if petitioner feels aggrieved, he may take recourse in accordance with law.
