2. The petitioner seeks bail in a case registered for the offence punishable under Section-302 of the Indian Penal Code and 3⁄4 of the Explosive Substances Act.

3. As per allegation, when the children of the village were playing, all of a sudden, the informant heard the sound of bomb explosion. He rushed there and found his six years son in injured condition. During course of treatment, the injured son of the informant died in the hospital.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in the present case. During entire investigation, nothing emerged

5. On the otherhand, learned APP Mrs. Suman Kumari Singh has opposed the prayer for bail by submitting that in paragraphs-10 & 11, the witnesses have stated that they had seen the petitioner coming towards the river in the morning of occurrence.

6. During the entire investigation, there is no material showing the complicity of the petitioner in the alleged occurrence. He is under custody since 13-12-2021.

7. Considering the aforesaid facts and circumstances, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-Ist Class, Bhagalpur in connection with Nathnagar P.S. Case No. 693 of 2021 with condition that the petitioner shall cooperate with the trial of the case and make himself available as and when required by the court.
