Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 366(A)/34 of the Indian Penal Code.
The accusation is kidnapping the minor sister of the informant.
It is submitted by learned counsel for the petitioner that in 164 Cr.P.C statement the victim though admitted that she met with this petitioner and Raj Kumar but it is alleged that Raj Kumar kept her in confinement and proposed to marry her. The petitioner happens to be uncle of the informant and the accusation has been levelled in the background of land dispute.
A statement has been made in para 3 of the
Patna High Court Cr.Misc. No.34785 of 2015 (2) dt.17-08-2015 2/2 petition that petitioner has no criminal antecedent. Considering the fact that in 164 Cr.P.C statement the victim has not alleged anything against the petitioner and thrust of accusation is against Raj Kumar, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sheohar in connection with Sheohar P.S. Case No. 105 of 2015, G.R. No. 282 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) Shageer/- U T
