JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-02-2017 The petitioner is apprehending his arrest in connection with Andharamath P.S. Case No. 04 of 2016, registered for offences punishable under Sections 341, 323, 498A, 504/34 of the Indian Penal Code and Section 3/4 of Dowry Prohibition Act later on Section 326, 307, 494, 120B and 506 of the Indian Penal Code was added.

It has been submitted on behalf of the petitioner that the petitioner is the devar of the victim girl and no specific overt act has been attributed to him and also other co-accused has already been granted bail.

Heard learned A.P.P. also.

Having heard both sides, considering the fact that he petitioner happens to be the devar of the victim girl and no specific allegation has been levelled against this petitioner, let the

Patna High Court Cr.Misc. No.4357 of 2017 (2) dt.13-02-2017 2/2 petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate-1st Class, Jhanjharpur, Madhubani in connection with Andharmath P.S. Case No. 4 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. This is subject to further condition that the petitioner shall cooperate in the investigation of case and make him himself present before the police as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
