The petitioner, who is in custody, seeks bail in connection with Ghorasahan P.S. Case No. 50 of 2018 registered for the offence punishable under Sections 363, 366/34 of the Indian Penal Code.

Allegation against petitioner is of kidnapping the wife of the informant who is of unsound mind. It has been submitted on behalf of the petitioner that petitioner is innocent and has been falsely implicated in this case. It has been further submitted that occurrence took place on 12.01.2018 and FIR was lodged on 07.02.2018 without any explanation of such delay. Statement under Section 164

Patna High Court Cr.Misc. No.58101 of 2018(2) dt.08-10-2018 2/2 Cr.P.C. recorded in which there is no allegation of any misbehave or sexual assault against petitioner. It has been further submitted that petitioner has no criminal antecedent and he is in custody since 13.07.2018.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., East Champaran, in connection with Ghorasahan P.S. Case No. 50 of 2018.
