Petitioners apprehend arrest in Bihiya Police Station Case No 226 of 2016 dated 21.08.2016 registered under Sections 452, 341, 354A, 468, 385, 504, 506/34 of Indian Penal Code.

Learned counsel for the petitioners submits that the petitioners have been implicated in this case on political considerations due to rivalry in the Mukhiya Elections. In fact, the informant owes the petitioner of Rs 10 lacs which he had advanced as a loan to the informant. In this connection, petitioner No 1 has also lodged Bihiya Police Station Case No

Patna High Court Cr.Misc. No.65560 of 2018(2) dt.13-12-2018 2/2 309 of 2016. As a result, in counterblast, the informant has lodged the instant case wherein the petitioners have falsely been implicated.

The learned APP for the State opposed the prayer for anticipatory bail.

Considering the aforesaid submissions,, prayer for anticipatory bail is allowed. In the event of their arrest or surrender before the Court within four weeks from today, the petitioners above named shall be released on bail on each of them furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhojpur at Ara in Bihiya Police Station Case No 226 of 2016 dated 21.08.2016 subject to all conditions as laid down in Section 438 (2) of Criminal Procedure Code.
