The petitioner seeks bail in a case registered under Sections 136, 418 of the Indian Penal Code and 27(b)(II)/28 of Drugs and Cosmetic Act, 1940.

Allegation is that the from the possession of the petitioner some medicines were recovered, which are prohibited by the government.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 9.1.2019 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. Allopathic medicines are said to have been recovered from the petitioner. The petitioner had no license

Patna High Court CR. MISC. No.20877 of 2019(3) dt.08-05-2019 2/2 to possess the drugs in question. Recovery of medicines are denied by the petitioner.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-I, Sitamarhi in connection with Kanhauli P.S. case No.03 of 2019.
