The petitioner apprehends his arrest in connection with Bhagwanpur P.S. Case No. 162 of 2016, registered for the offences punishable under Sections 341, 323, 307, 337, 504/34 of the Indian Penal Code.
Allegedly, the informant was assaulted by the petitioner and co-accused by bricks, stone, lathi and danda, resulting, he became injured.
Submission is of false implication and that against the petitioner there is no specific allegation, specific allegation is against Awadhesh Singh and Shishu Singh who have assaulted the informant with bricks causing head injury and thereafter it is alleged that petitioner and anothers also assaulted him. Patna High Court Cr.Misc. No.2688 of 2017 (2) dt.25-01-2017 2/2 found on the person of the informant are simple in nature and, as such, the petitioner deserves sympathetic consideration. The learned A.P.P. opposes the prayer of pre-arrest bail by submitting that the petitioner is named in the F.I.R. In the facts and circumstances as stated above, considering the injury report, the petitioner in the event of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabua, in connection with Bhagwanpur P.S.
