Learned counsel for the petitioner is directed to remove the defect(s), as pointed out by the office, within a period of four weeks.
The petitioner is apprehending his arrest in Runnisaidpur P.S. Case No. 367 of 2018 registered under Sections 147, 148, 341, 323, 324, 307, 504, 379 of the Indian Penal Code.
Allegedly, while the informant was working in his vegetable field, the FIR named accused persons having armed with farsa, Bhala and lathi came in his field and started abusing and in consequence thereof, the petitioner is said to have assaulted the informant on his head with farsa whereas Mukesh Rai @ Munna assaulted on his arm with Bhala.
Patna High Court CR. MISC. No.30532 of 2021(3) dt.07-03-2022 2/2 It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has been falsely implicated in the present case. From perusal of the case diary, it appears that there is no injury report on the record. It cannot be ascertained as to whether nature of injury is grievous or not. Due to village politics, the alleged occurrence is said to have taken place.
On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.
Considering the aforesaid facts and circumstances of the case, the petitioner, above named, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Runnisaidpur P.S. Case No. 367 of 2018 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
