2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 341, 323, 325, 307, 504, 506 and 34 of the Indian Penal Code, Section 27 of the Arms Act and Section 30(a) of the Bihar Prohibition and Excise Act.

3. As per prosecution case, on the alleged date and time of occurrence, while informant was sleeping after closing his shop, all the F.I.R. named accused persons, including this petitioner, came there and insisted to park his bike there only. Upon denial, all the accused persons abused and assaulted informant and co-accused Jitendra Kumar Mandal fired from his pistol causing gun shot injury on palm of informant.

It is submitted by learned counsel appearing on behalf of the petitioner that petitioner has falsely been implicated in this case merely because he happens to be owner of the seized motorcycle in question. There are general and omnibus allegations and no specific accusation of overt act has been alleged against this petitioner. Petitioner claims clean antecedents.

5. On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner and submitted that petitioner is named in the F.I.R. and is registered owner of the motorcycle in question.

6. Considering the facts and circumstances of the case and nature of accusation, the prayer for grant of anticipatory bail to the petitioner is rejected.
