The matter is being heard through video conferencing due to circumstances prevailing on account of Covid-19 pandemic.

Heard learned counsel for the petitioner and learned APP for the State.

The petitioner apprehends his arrest in connection with Bihar P.S. Case No.35 of 2020 registered for offences under Sections 419, 420, 467, 468, 471 and 120(B)/34 of the Indian Penal Code.

Considered the submissions of the parties.

Considering the fact that the petitioner is 52 years old

Patna High Court CR. MISC. No.31492 of 2021(2) dt.04-03-2022 2/2 and there is no chance of his absconding during trial, this application for anticipatory is allowed.

Accordingly, let petitioner, above-named, in the event of his arrest or surrender within four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Bihar P.S. Case No.35 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

It is made clear that the petitioner shall cooperate the court below in conclusion of the trial and he shall be represented in the trial on each and every date.
