Let the defect(s), if any, be removed within a period of four weeks from today.

The petitioner seeks bail in connection with Ghoswari P.S. Case No. 71 of 2022 registered for the offence under Sections 25(1-b)a, 26, 35 of the Arms Act. The prosecution story in short is that on getting information, the informant along with other police personnel reached Nakta Pool and caught three persons including

Patna High Court CR. MISC. No.22793 of 2023(2) dt.17-05-2023 2/3 petitioner and on search one country made pistol, four live cartridges, 14 pieces iron trigger and other articles were recovered form the possession.

Learned counsel for the petitioner submits that the petitioner is in custody since 30.04.2022 and has falsely been implicated in this case.

Learned A.P.P. has vehemently opposed the prayer for bail.

Considering the period of custody and the fact that the co-accused have been granted bail by this Court vide order dated 16.12.2022 (Annexure-2), this application for regular bail is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. 1st Class, Barh in connection with Ghoswari P.S. Case No. 71 of 2022.

The petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court and on absence on two consecutive dates without sufficient reason, the bail bond of the petitioner shall be cancelled by the Court below.
