This application has been filed for quashing the order dated 24.4.2004 passed in Chakmehsi P.S. Case No.24 of 2002 by the Chief Judicial Magistrate, Samastipur by which he has taken cognizance against the petitioner for offences under Sections 396 and 120 B of the Indian Penal Code and also for quashing the order dated 3.8.2012 passed in Cr. Revision No.257 of 2004 by the IVth Additional Sessions Judge, Samastipur by which he has refused to interfere with the order of cognizance.
Dacoity and murder has taken place in the house of the
Patna High Court Cr.Misc. No.48279 of 2012 (2) dt.07-05-2015 informant and other houses also.
Learned counsel for the petitioner submits that there is no material whatsoever against the petitioner as FIR has been lodged against unknown and after a long delay the informant and son of the informant has shown a suspicion of involvement of the petitioner. The police has submitted final form.
This Court is not inclined to interfere with the matter at this stage. Accordingly this application is dismissed. However, the petitioner will be at liberty to raise all points before the court below at the appropriate stage. (Shivaji Pandey, J) Vinay/- U T
