The petitioners apprehend their arrest in a case under Sections 304(B), 201/34 of the Indian Penal Code. The father of the deceased made an allegation that his daughter was married with Sanoj Yadav, petitioner no. 3 on 20.05.2008 but her husband and other in-laws were demanding motor cycle and for non fulfillment of the same, the petitioners killed his daughter and immediately cremated the dead body. It is alleged that the marriage was solemnized about six years before the death of the deceased but no specific allegation is made against the father-in-law and brother-in-law of the deceased, who are petitioner nos. 1 and 2 here. Considering the facts aforesaid, let petitioner no. 1 Yogendra Yadav and petitioner no. 2 Sunil Yadav alias Sunil
Patna High Court Cr.Misc. No.30546 of 2014 (5) dt.08-04-2015 Kumar, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya in connection with Wazirganj P.S. Case No. 127 of 2014, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure, 1973.
So far as petitioner no. 3, Sanoj Yadav is concerned, he is the husband of the deceased. There is allegation that he was demanding a motor cycle and even after death of his wife, the parents of the deceased were not informed and the dead body was cremated.
Considering the facts aforesaid, I am not inclined to grant anticipatory bail to petitioner no. 3 in connection with Wazirganj P.S. Case No 127 of 2014. His prayer for grant of anticipatory bail is accordingly rejected. However, if so advised, he may surrender and seek regular bail in the court below. (Prabhat Kumar Jha, J) Amin/- U
