The petitioner is accused in connection with Amarpur P.S. Case No. 359 of 2015 registered under Sections 147, 148, 149, 341 and 302 of the Indian Penal Code and Section 27 of the Arms Act, pending in the court of Chief Judicial Magistrate, Banka.

The accusation is that 12 persons including the petitioner surrounded Mahesh Panjiyara, grandfather of informant, in course of returning from Civil Court, Banka and Pappu shot fire at Mahesh Panjiyara through Pistol. Thereafter this petitioner also shot fire at the chest of Mahesh Panjiyara, who died at the spot. Having considered the direct allegation against the
