JUSTICE SANJAY PRIYA ORAL ORDER 01-03-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Digha P.S. Case No. 230 of 2016 instituted for the offence under Sections 304B, 498A, 120B and 34 of the Indian Penal Code. It has been submitted on behalf of the petitioner that the petitioner is the younger brother of the husband of the deceased.

In the written report, it is alleged that the informant received information that his daughter has committed suicide in her sasural. He rushed there and found his daughter dead hanging with a fan. On seeing the dead body, it appeared that after committing murder, the dead body was hanged. It has further been alleged that she was tortured by her husband and his other family

It has been submitted on behalf of the informant that earlier the husband of the deceased performed two marriages. One marriage ended in divorce and in second, the wife was done to death.

It is admitted position that the petitioner is brother of the husband of the deceased.

The learned A.P.P. has submitted that from perusal of the case diary, it appears that there is general and omnibus allegation against the petitioner.

Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioner is allowed. In the event of surrender/arrest of the petitioner, named above, within six weeks from today, in connection with Digha P.S. Case No. 230 of 2016, he shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Mohd. Inam Khan, Judicial Magistrate, 1st Class, Patna, subject to the conditions as laid down under Section 438 (2) Cr. P.C.
