JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 21-02-2017 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the State.

In this application for anticipatory bail the petitioner apprehends his arrest in connection with Jamui Nagar P.S. Case No. 306 of 2015 for the offences punishable under sections 467, 468, 471, 420 and 120 (B) of the I.P.C.

Allegedly, the petitioner got job of teacher on the basis of forged certificate.

Submission is of false implication and that the petitioner was himself cheated by Guru Nanak College of Education, New Delhi and the petitioner has filed Complaint Case No. 1007 of 2016 in the court of the learned C.J.M. Nawada, the petitioner has not been paid single farthing towards the salary in

Patna High Court Cr.Misc. No.1980 of 2017 (3) dt.21-02-2017 2/2 lieu of teaching, he has already been terminated from the service and in such cases the accused persons have been granted pre-arrest bail by another co-ordinate Bench of this Court, vide Cr. Misc. No. 4306 of 2017, and as such the petitioner also deserves sympathetic consideration.

The learned A.P.P. opposes prayer for pre-arrest bail of the petitioner.

In the facts and circumstances as stated above, the petitioner, in case of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of. C.J.M. Jamui in connection with above mentioned case, subject to the conditions as laid down in section 438 (2) of the Cr.P.C.
