The petitioner seeks regular bail in connection with Rajgir P.S. Case No. 289 of 2018 for the offences punishable under Sections 365/34 and 302 of the Indian Penal Code. The case of the prosecution is that the Manager of a Bank i.e. the deceased of the present case, used to travel on his motorcycle/ bike from his village to Bank and back every day, however, he went missing in the evening on 27.9.2018 and his dead body was found after some days thereafter. The complicity of the petitioner has transpired upon confessional statement having been made by the co-accused Chandan Kumar. No.19063 of 2019(2) dt.05-04-2019 2/2 is no material on record to suggest that the petitioner has any role to play in the alleged crime and the petitioner is languishing in custody since 07.10.2018. Lastly, it is submitted that similarly situated other accused persons have already been granted bail by a co-ordinate Bench of this Court vide order dated 17.01.2019 and 12.3.2019 passed in Cr. Misc. Nos.197 of 2019 and79550 of 2018.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Rajgir P.S. Case No. 289 of 2018.
