The petitioner seeks bail in a case registered for offences punishable under Section 30 (a) and 37(b) of the Bihar Prohibition and Excise Act, 2016.
It is contended that, as per allegation, the police party apprehended the petitioner and from his possession, 24 litres country made liquor and 1.875 litres foreign liquor were recovered. It is contended that the seized liquors do not belong to the petitioner rather the same belong to some other person who managed to escape and the petitioner has falsely been implicated in this case. Petitioner claims that he is having clean antecedent and is in custody since 26.07.2018.

No.59044 of 2018(2) dt.06-10-2018 2/2 Having regard to the facts and the circumstances of the case, the abovenamed petitioner is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Second Additional District and Sessions Judge-cum-Special Judge, Excise, Bhagalpur, District, Bhagalpur in connection with Bhagalpur G.R.P. S. Case No. 156/2018.
Further, if the petitioner, after his release in this case, is again found to be involved in similar nature of case then the court concerned would be at liberty to take steps for cancellation of his bail bond.
