Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 447, 342, 323, 324, 326, 307 of the Indian Penal Code.

The prosecution case is that informant was sitting with his brother and father at his door when the petitioners came armed with deadly weapons and started assaulting indiscriminately to the father of the informant. It is further alleged that petitioners also assaulted to the father of the informant on his head by Dab trice, as a result he fell down and when informant and his brother came to rescue then they

Patna High Court Cr.Misc. No.36089 of 2015 (4) dt.23-09-2015 2/2 were also assaulted by the accused persons with Dab. It is submitted by learned counsel for the petitioners that accusation is omnibus and general. The injuries of the informant, his father and brother have been found to be simple. There is counter version of the occurrence and petitioners' side also received injuries. The petitioners are agnates of the informant and in the background of land dispute the accusation has been levelled.

It is submitted by learned counsel for the informant that all the three injured have received injuries on vital part of the body which reflects the intention of the petitioners.

The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioners surrender within a period of six weeks in connection with Ganga Bridge P.S. Case No. 35 of 2015, pending in the Court of learned Chief Judicial Magistrate, Hajipur at Vaishali. With the observations above, the application stands disposed off.
