JUSTICE SUDHIR SINGH ORAL ORDER 23-09-2016 Heard learned counsel for the petitioners, the State and the informant.

The petitioners seek bail in a case instituted for the offence under Sections 341, 324, 326, 307 and 120(B)/34 of the Indian Penal Code and Section 27 of the Arms Act. The allegation is that the accused persons including the petitioners and 2-3 unknown persons have made indiscriminate firing on the informant with an intention to kill him.

It has been submitted on behalf of the petitioners that the petitioners are in custody since 8.3.2016 and charge sheet has been submitted in the present case. There is no allegation of

Patna High Court Cr.Misc. No.32527 of 2016 (3) dt.23-09-2016 2/2 tampering of witnesses alleged against the petitioners. The petitioners have falsely been implicated in the present case. General and omnibus allegation has been made against the petitioners. No specific injury has been attributed against them. It is further submitted that the petitioners may be released after completion of nine months in custody from 8.3.2016. On behalf of the State and the learned counsel for the informant, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioners be released on bail after completion of nine months in custody from 8.3.2016 on furnishing bail bond of Rs. 10,000/-(Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Sonbarsa P.S. case No.09 of 2015.
