The petitioner seeks bail in anticipation of his arrest in connection with Ekma P.S. Case No. 58 of 2021, dated 09.02.2021, instituted for the offences under Sections 30(a) and 37(b)(c) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

No.28644 of 2021(2) dt.13-01-2022 2/2 Notwithstanding the fact that the petitioner is being prosecuted in this case on the basis of confession of one of the arrested accused persons, but keeping in mind that he was earlier, twice, made an accused in a case of similar nature, I am not inclined to grant him anticipatory bail. The prayer for grant of anticipatory bail to the petitioner is, accordingly, rejected.

However, if he surrenders before the Court below and seeks bail, the Court below shall consider the case on its own merits, without being prejudiced by the fact that the present anticipatory bail application has not been entertained by this Court.

The application stands dismissed.
