Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 431, 323, 307, 435, 427, 504, 353 of the Indian Penal Code.
The prosecution case is that two persons were crushed by a pick-up van when 100-125 people made protest, put the pick-up van on fire and when the police went to pacify then gypsy of the Dy. SP was also put on fire. The local people and Chaukidar suggested the name of the petitioner and others.
It is submitted by learned counsel for the petitioner that only on suspicion the accusation has been levelled. The accusation is against the mob and the F.I.R
Patna High Court Cr.Misc. No.36989 of 2015 (2) dt.15-09-2015 2/2 named co-accused Kundan Yadav has been granted bail vide Cr. Misc. No. 31819 of 2013.
A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura in connection with Madhepura P.S. Case No. 334 of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
