JUSTICE SUDHIR SINGH ORAL ORDER 16-09-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 304B, 201 and 120 of the Indian Penal Code. Informant's daughter was married with one Sunil Kumar, who had illicit relation with wife of Ram Prasad. On being protest, informant's daughter was being tortured and ultimately she was killed by the in-laws.

It has been submitted on behalf of the petitioner that she is in custody since 14.6.2016. Chargesheet has been submitted against the petitioner. Petitioner has got no criminal antecedent. No allegation of tampering of witnesses is alleged against the petitioner. Petitioner is mother-in-law of the deceased. She is separate in mess and property from the husband of the deceased. The statement of the deceased has been recorded in para-20 of the case diary where she has admitted that due to accidental fire she has sustained burn injury. Other co-accused has been granted bail vide Annexure-5 to the present application.

On behalf of the State, it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the

No.32190 of 2016 (3) dt.16-09-2016 2/2 above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Arwal, in connection with Arwal P.S. Case no. 272 of 2014.
