Petitioners apprehend arrest in connection with L.N.M.U. P.S. Case No. 70 of 2016 registered under Sections406, 420, 120B of the Indian Penal Code and section 138 of the Negotiable Instruments Act.
The allegation against the petitioners is that they fraudulently took five lacs as advance for selling a land in favour of the informant, however on asking for the same they avoided on one pretext or the other. Accused Dilip Paswan gave cheque of Rs. 2,00,000/- which became dishonoured. Learned counsel for the petitioner submits that
Patna High Court Cr.Misc. No.1370 of 2017 (2) dt.16-01-2017 2/2 petitioners have no concern with the deal between Dilip Paswan and informant.
Considering the gravity of allegations levelled against the petitioners coupled with the fact that they have criminal history, I am not inclined to grant the privilege of anticipatory bail to the petitioners. Their prayer for anticipatory bail is, accordingly, rejected.
