Heard learned counsel for the petitioner no. 1 and the State.
The petitioner no. 1 is apprehending her arrest in a case registered for the offences punishable under Sections 341, 323, 308, 504/34 of the Indian Penal Code.
It is alleged that Deepak Pandey caused injury on the head of the informant with Spear. When the daughter of the informant came to rescue then Deepak Pandey also assaulted her on the head with Spear. When the son of the informant came to rescue his sister then Upendra Pandey pelted bricks on her, whereas when the wife of the informant came to rescue then this petitioner also pelted bricks. Patna High Court Cr.Misc. No.31794 of 2014 (3) dt.03-02-2015 suggested that the wife of the informant received four injuries, but all are simple in nature.
Considering the nature of accusation against petitioner no. 1 being a lady, let the above named petitioner no. 1 be released on anticipatory bail in the event of her arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Nalanda at Biharsharif in connection with Rahui P.S. Case No. 83 of 2014, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
