Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 419, 420 of the Indian Penal Code and 7 of the Essential Commodities Act.

Prosecution case is that 51 pockets of rice, 49 pockets of wheat and 632 liters of Kerosene Oil were recovered from the possession of the petitioner being a P.D.S. dealer. It is submitted by the learned counsel for the petitioner that seizure list does not suggests the signature of the petitioner or any of his family members. It is submitted that without verifying the stock of the petitioner being a P.D.S. dealer the accusation has been levelled.

Considering the nature of accusation, let the

No.36536 of 2015 (2) dt.10-09-2015 learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Parsa P.S. Case No. 61 of 2015, pending in the court of learned Sub-Divisional Judicial Magistrate, Chapra. With the above observation this application is disposed of.
