For the Petitioners : Mr. Satyendra Narayan Singh, Advocate For the Opposite Party : Mr. Anand Kishore Choudhary, APP ====================================================== CORAM: HONOURABLE THE ACTING CHIEF JUSTICE ORAL ORDER 05-08-2015 Heard Mr. Satyendra Narayan Singh, learned Counsel, appearing for the petitioners, and Mr. Anand Kishore Choudhary, learned Additional Public Prosecutor, for the State. By the order, dated 10.07.2015, passed in Cr. Misc. No. 15661 of 2015, the petitioners were granted pre-arrest bail with the direction that, "the petitioners above-named, shall, within two weeks from today, appear before the Officer-inCharge, Tariyani Police Station, and make themselves available for interrogation by police at all reasonable time and shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade them from disclosing such facts to the Court or to any police officer."

It has, now, come to the notice of the petitioners that on completion of the investigation, police has already submitted

Patna High Court Cr.Misc. No.35832 of 2015 (2) dt.05-08-2015 2/2 its report exonerating the petitioners and the same is presently pending consideration by the learned Additional Chief Judicial Magistrate, Sheohar.

In view of the above and in the interest of justice, it is directed that the petitioners above-named shall, in the event of their arrest in connection with the case aforementioned, be released on bail of Rs. 10,000/-, with two sureties, each of the like amount, subject to the satisfaction of the learned Additional Chief Judicial Magistrate, Sheohar, in connection with Tariyani Police Station 232 of 2014. This direction for pre-arrest bail is further subject to the condition that the petitioners above-named shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade them from disclosing such facts to the Court or to any police officer.

The order, dated 10.07.2015, passed in Cr. Misc. No. 15661 of 2015, shall stand modified to the extent as indicated hereinabove.

With the above observations and directions, this application shall stand disposed of.
