The petitioner seeks regular bail in connection with Phulwarisharif (Janipur) P.S. Case No. 560 of 2021 lodged under Sections 363,366A and 120(B)/34 of the Indian Penal Code.
The informant lodged the F.I.R. that earlier the petitioner Ranjeet Kumar with the help of his father and other relatives have abducted her daughter for which a criminal case bearing Phulwarisharif (Janipur) P.S. Case No. 311 of 2021 was registered. It was alleged that police recovered the daughter of informant and handed over to the informant by the Court. Patna High Court CR. MISC. No.20043 of 2022(2) dt.21-07-2022 2/3 enticed away and again there was no trace of her daughter till date, in result the present case i.e. Phulawirsharif (Janipur) P.S. Case No. 560 of 2021 was lodged, in which the petitioner is praying for bail.
Learned counsel for the petitioner submits that he is completely innocent and has committed no offence. Learned counsel for the petitioner further submits that the alleged victim i.e. daughter of informant in her statement under Section 164 of Cr.P.C. categorically stated that she herself went out side from her house and called Ranjeet. It has also been deposed by her that family members were not ready for marriage, therefore, we both by their consent have solemnized their marriage. Learned counsel further submits that in the present case the alleged victim i.e. daughter of informant has given her statement under Section 161 of Cr.P.C. categorically stated that she and Ranjeet Kumar solemnized their marriage with their consent and no one is responsible for the same. She also stated that she hereself went out side from her house.
Patna High Court CR. MISC. No.20043 of 2022(2) dt.21-07-2022 3/3 concerned from the Adhar Card annexed as Annexure-VI it transpires that the daughter of the informant is major. Learned counsel for the petitioner further submits that petitioner is in custody since 25.07.2021 and charge sheet has already been filed having no criminal antecedent other than the case, which has been filed for the same informant earlier. Learned counsel for the State submits that when there is continuous acceptance of the alleged victim i.e. daughter of the informant about her involvement in alleged event then it creates doubt in the prosecution case.
In the present facts and circumstances and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Judge-IX-cum- Addl. Chief Judicial Magistrate-IX, Patna/ concerned Court in connection with Phulwarisharif (Janipur) P.S. Case No. 560 of 2021, subject to the conditions as laid down under Section 437(3) of Cr.P.C.
