JUSTICE BIRENDRA KUMAR ORAL ORDER 29-10-2018 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147/149/504/506/353 of the Indian Penal Code. The informant police had arrested to the wife of petitioner No.1, who is sister of petitioner No.2, in a case registered under Sections 467/468/471/420/34 of the Indian Penal Code. She could not be produced in Court on the first day of arrest and on the second day when the prisoner was being brought to the Court the petitioners allegedly scuffled with the police and obstructed in their discharge of official duty. Patna High Court Cr.Misc. No.58592 of 2018 (2) dt.29-10-2018 P2/ stated on oath that they have got no criminal antecedent. Considering the nature of allegation, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs.20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Gaya Civil Line Police Station Case No.240 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioners shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
