JUSTICE SANJAY PRIYA ORAL ORDER 16-01-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks anticipatory bail in a case instituted for the offence under Sections 363 and 366 of the Indian Penal Code.

It is alleged in the written report that on 13.7.2016 when the daughter of the informant was studying in courtyard, she had been kidnapped by the petitioner. The learned counsel for the petitioner has referred to the statement of victim girl recorded under Section 164 Cr. P.C. kept as Annexure-2 wherein the victim girl has stated that she has voluntarily married with the petitioner and she has not been kidnapped. Her father has filed a case against her husband.

The court has assessed the age of the victim as 19

Patna High Court Cr.Misc. No.1394 of 2017 (2) dt.16-01-2017 2/2 years whereas the victim has also stated that she is 18 years old. She has also been medically examined and a copy of medical report is annexed as Annexure-3 wherein the Doctor has opined the age of the victim between 17 to 18 years. Considering the aforesaid facts and circumstances of the case, let the Petitioner in the event of surrender, named above, within six weeks from the date of receipt of this order, in connection with Kursakanta (Kuari) P.S. Case No. 160 of 2016, shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Araria, subject to the condition as laid down under Section 438(2) Cr. P.C.
