JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 10-04-2015 Learned counsel for the petitioners submits that the allegation being that the petitioners had taken a housing loan from the Bank of Baroda, Katihar, on the basis of mortgage executed in relation to certain land. The allegation further being that upon verification it was found that the security offered was not genuine. They had only partly paid the housing loan and then defaulted. Learned counsel for the petitioners submits that petitioners are ready to liquidate the entire outstanding housing loan and it is only to unnecessary harass them this case has been lodged.
Be that as it may, considering the aforesaid, for a period of six months from today, the petitioners
Patna High Court Cr.Misc. No.41653 of 2014 (2) dt.10-04-2015 above-named shall released on provisional bail. They would utilize this time to liquidate the entire dues of the Bank i.e. principal and accrued interest after adjustment of amount already paid. Upon end of six months, they must satisfy the trial court about liquidation of entire dues and, if they fail to do so, then the order of this Court granting them provisional bail in anticipation of arrest furnishing bail bond of Rs. 10,000/- (ten thousand only) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Katihar, in connection with Mansahi P.S. Case No. 53 of 2012, subject to condition laid down under Section 438 (2) of the Code of Criminal Procedure, would stand cancelled. Accordingly, petitioners should surrender before the trial court within two weeks from today, the trial court would release them on bail, subject to the conditions as stipulated above.
