JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections 326, 307 and 395 of the Indian Penal Code. Petitioner is not named in the first information report but in course of investigation, he and some others were caught with stolen vehicle for which Obra P.S. case No.118 of 2015 was lodged against the petitioner and others.

No doubt, petitioner has already been granted privilege of bail in Obra P.S. Case No.118 of 2015, but taking note of his criminal antecedent as well as facts of the present case, I am not inclined to release the petitioner on bail and, hence, his prayer for bail in connection with Belaganj P.S. Case No.267 of

Patna High Court Cr.Misc. No.30190 of 2016 (3) dt.04-10-2016 2/2 2015 pending in the court of Additional Chief Judicial Magistrate, IIIrd, Gaya stands rejected.
