JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 19-06-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in registered for the offences punishable under Section 30a of the Bihar Prohibition and Excise Act.

As per the prosecution case, huge quantity of illegal liquor was recovered from the Pick Up vehicle of which petitioner is the registered owner.

Learned counsel appearing for the petitioner submits that no incriminating material has been recovered from the conscious possession of the petitioner and he is no way connected with the aforesaid recovery. Petitioner claims clean antecedent.

Learned counsel for the State opposes the prayer for bail. He submits that petitioner is the owner of the vehicle from

Patna High Court CR. MISC. No.20718 of 2023(3) dt.19-06-2023 2/2 which there is recovery of illicit liquor, as such, he cannot escape responsibility.

Considering the aforesaid facts, prayer for bail of the petitioner is refused.
