JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 399, 402, 414 of the Indian Penal Code and Sections 25(1-b)A, 26, 35 of the Arms Act. Two live cartridges and mobile phones are said to have been recovered from possession of the petitioner when he along with others had assembled to make preparation for committing dacoity. For the aforesaid recovery, petitioner is in jail custody since 30.12.2015.

No doubt, petitioner does have some criminal antecedent but considering the aforesaid facts and circumstances

Patna High Court Cr.Misc. No.29759 of 2016 (2) dt.28-07-2016 2/2 as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-VIII, Motihari, East Champaran in connection with Patahi P.S.
