Petitioner seeks bail in connection with Dhaka P.S. Case No. 253 of 2018 registered for the offence punishable under sections 341, 448, 323, 504, 506, 379 and 354B/34 of the Indian Penal Code.
Learned counsel appearing for the petitioner submits that petitioner has falsely been implicated in this case due to admitted land dispute and previous enmity. The allegation of theft under Section 379 of the I.P.C. is super addition and no case under Section 354B of the I.P.C. is made out and rest Sections are bailable. There is case and counter case between the parties vide Dhaka P.S. Case No. 254 of 2018. Petitioner has no criminal antecedent and is in custody since 31.07.2018.

No.58262 of 2018(2) dt.28-09-2018 2/2 Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Siokrahan at Dhaka, East Champaran in connection with Dhaka P.S. Case No. 253 of 2018.
