JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-04-2019 This application, for grant of anticipatory bail, arises out of G.B. Nagar P.S. Case No. 262 of 2018, disclosing offences under Sections 272, 273 and 308 of the Indian Penal Code and Section 30A/38/41(1) of the Bihar Excise and Prohibition Act, 2016.

Allegation is of recovery of 4.8 litres of liquor from the bush situated beside the house of petitioner. Submission of learned counsel for the petitioner is that she has falsely been implicated in this case and nothing has been recovery either from the conscious possession of the petitioner or from her house rather recovery has been made from the bush. Statement has been made in paragraph -3 of the petitioner that petitioner has no criminal antecedent.

Having heard both sides, considering the submission, as above, this application is allowed. Let the petitioner, above named, in the event of her arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge -II cum Special Judge Excise, Siwan, in connection with G.B. Nagar P.S. Case No. 262 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
