====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 13-12-2021 Heard learned counsel for the petitioner and the State. The petitioner prays for grant of regular bail in a case registered for the offence punishable under sections 302/120B of the Indian Penal Code and section 27 of the Arms Act. As per the prosecution case, four motorcycle borne miscreants came to the shop of the informant and made firing resulting in death of brother of the informant and informant claimed that miscreants can be identified by the CCTV footage of the shop.

Learned counsel for the petitioner submits that the petitioner's name has figured during course of investigation in confessional statement of co-accused Raj Sagar who has already been allowed bail by a co-ordinate bench of this Court

Patna High Court CR. MISC. No.29348 of 2021(4) dt.13-12-2021 2/2 vide order dated 6.10.2018, passed in Cr.Misc.No. 56175 of 2018 besides other accused persons who have also been allowed bail vide paragraph 14 of the bail petition. No other substantive evidence has been collected during course of investigation to suggest the implication of this petitioner in the present case. Petitioner has claimed clean antecedent and he is in custody since 12.1.2021.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in Hajipur Industrial Police Station Case No. 85 of 2018.
