Petitioner prays for bail in connection with Jehanabad P.S.Case No. 98 of 2015 registered for the offences punishable under Sections 323, 324, 326, 307, 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

Allegation against the petitioner and other accused persons is of committing murder of father of the informant and there is allegation against the petitioner that he chased the deceased having Tangi in his hand.

Prayer for bail of the petitioner was earlier rejected vide order dated 6.5.2016 passed in Cr.Misc.No.12270 of 2016. Submission of learned counsel for the petitioner is that informant has been examined in this case as a witness and he has stated that deceased was chased by the petitioner having Tangi in

Patna High Court Cr.Misc. No.57723 of 2018 (2) dt.28-09-2018 2/2 his hand and only one witness has to be examined in this case and petitioner is in custody since 6.11.2015.

Heard learned APP also.

Having heard both sides and in view of allegation, I am not inclined to grant bail to the petitioner. However, since petitioner is in custody for the last 2 and 1⁄2 years, learned trial court is directed to expedite the trial and try to conclude it within a period of six months. Needless to say that petitioner has to co-operate in disposal of trial. With the above observation, this application is dismissed. (Vinod Kumar Sinha, J) spal/- U T
