JUSTICE BIRENDRA PRASAD VERMA ORAL ORDER 03-10-2016 After some argument, the learned counsel appearing on behalf of the petitioner, in presence of the learned counsel appearing on behalf of the respondents, seeks permission to withdraw the present writ petition with a liberty to approach the Civil Court of competent jurisdiction for grant of appropriate relief(s) to the petitioner with respect to the lands in question claimed by him.

Permission is accorded.

Patna High Court CWJC No.17288 of 2014 (2) dt.03-10-2016 The writ petition stands dismissed as withdrawn with the liberty aforesaid.

It goes without saying that, if the claim of right, title and possession of the petitioner is accepted by the Civil Court of competent jurisdiction, after hearing all the parties including the private respondents herein, then he shall be at liberty to file a fresh petition for mutation of his name with respect to the lands in question before the prescribed authority.
