JUSTICE BIRENDRA KUMAR ORAL ORDER 14-05-2019 By order dated 22.04.2019, on the prayer of the petitioners, name of the petitioner no. 2 Ankit Kumar was deleted from the record for the reason that office has raised objection that separate petition against individual impugned order requires to be filed.

Heard learned counsel for the petitioner no. 1 and learned APP for the State.

Petitioner no. 1 seeks bail in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Allegation is that from a Maruti car, foreign liquor was recovered and petitioner no. 1 was apprehended from the said car. Petitioner no. 1 has got no criminal antecedent. He is in

Patna High Court CR. MISC. No.22374 of 2019(3) dt.14-05-2019 2/2 custody since 27.01.2019. Investigation of the case is complete. Considering the aforesaid facts, let the petitioner no. 1 Rajesh Mandal, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Mansi Police Station Case No. 16 of 2019, with the following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned court-below having immovable property.

(b) The petitioner no. 1 shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner no. 1. (Birendra Kumar, J) Rajan/Banti U T
