====================================================== CORAM: HONOURABLE MR. JUSTICE KHATIM REZA ORAL ORDER 02-07-2025 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

2. The petitioner apprehends arrest in connection with Kachhawan PS Case No. 119 of 2024 dated 17-08-2024, instituted under Sections 406 of the Indian Penal Code and Section 3⁄4 of the D. P. Act.

3. The allegation against the petitioner is that he advised the informant to solemnize the marriage of his daughter with Srikant Kumar, son of Gorakh Singh.

4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in the present case. It is further submitted that the petitioner is a

Patna High Court CR. MISC. No.19155 of 2025(3) dt.02-07-2025 2/3 relative of both parties, namely, the informant and Gorakh Singh. There is no specific allegation against the petitioner that he ever demanded or received any money or a bullet motorcycle. It is next submitted that all the demands for dowry were made by Gorakh Singh and were fulfilled by the informant. Further submission is that all the money given by the informant to Gorakh Singh has been returned. Lastly, it has been submitted that the petitioner has no criminal antecedents. 5.Learned counsel for the informant and learned APP for the State have vehemently opposed the prayer for bail. It is submitted that the petitioner negotiated the marriage between the informant's daughter and the son of Gorakh Singh. It is further submitted that Rs. 3,50,000/- remains outstanding against Gorakh Singh.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM III, Bikramganj, Rohtas, in Kachhawan PS Case No. 119 of 2024, subject to the conditions laid down in Section 482(2) of

Patna High Court CR. MISC. No.19155 of 2025(3) dt.02-07-2025 3/3 the Bharatiya Nagarik Suraksha Sanhita 2023.
