18-08-2016 Heard Sri Y.C.Verma, learned senior counsel, who was assisted by Sri Rajani Kant Singh, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody in Dawath P.S. Case No. 107 of 2015 registered for offences under Sections 147, 148, 149, 341, 323, 324, 307 and 302 of the Indian Penal Code, has prayed for grant of bail, mainly on the ground of equality. Learned senior counsel for the petitioner, by way of referring to F.I.R., submits that allegation levelled against the petitioner is identical to allegation levelled against one co-accused Teju Ram. He has referred to Annexure - 3 to the petition i.e. an order dated 24-06-2016 passed in Cr. Misc. No. 17355 of 2016. He submits that Teju Ram has already been granted bail, mainly
Patna High Court Cr.Misc. No.32193 of 2016 (2) dt.18-08-2016 2/2 on the ground that there was general and omnibus allegation as well as the fact that chargesheet has already been submitted. Keeping in view the fact that in identical situation since co-accused Teju Ram has already been granted bail, vide Annexure - 3 to the petition, there is no reason to further detain the petitioner.
Accordingly, let the petitioner namely Ramesh Ram be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Bikramganj, District - Rohtas in connection with Dawath P.S. Case No. 107 of 2015.
